Consent to Learn. You have registered for a FurKids First Aid Course and will be referred to as the Student. You are granted access to these pages conditional upon your agreement to indemnify FurKids First Aid and not to hold it liable in any way for the results of any action you may take based on the material contained herein. FurKids First Aid does not guarantee that the functions or material contained on this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the materials. The course is to be completed at your own schedule and there is no time limit.
Assumption of Risk. The Student will assume all risks associated with handling of animals. Those risks include the risk of injury or death of the animal, the risk that first aid may not be an effective treatment, and the risk of personal injuries or destruction of property caused by the animal. This course includes animal medical emergency procedures collated by FurKids First Aid. The site is largely not concerned with providing specific veterinary advice. Where veterinary information concerning pets' conditions, symptoms and medications is given this should not be used for diagnosing or treating a veterinary problem and is in no way a substitute for taking your pet to see the vet. If you believe your pet may be sick or injured you should consult your own vet. The student has considered those risks, and relying on his/her own judgement, voluntarily understands and agrees to assume those dangers and risks.
Waiver of Claims. The Student, individually, and her his/her spouse, heirs, and assigns, hereby waives any claims arising out of or related to the knowledge learned in this course, now or in the future, against FurKids First Aid, its agents, employees, volunteers or students. If you fail for whatever reason to participate in or complete your course(s), you must still pay to FurKids First Aid the full fee for your course(s). There shall be no refund or discount of fees following the start of the course. Because of the way our courses are structured, once your booking is confirmed we are unable to transfer you to another course, or to offer any refunds. There are no exceptions to this.
Indemnity. The Student agrees to hold harmless and indemnify FurKids First Aid and its agents, employees, volunteers, or students from and against any and all claims, demands or lawsuits for property damage, personal injury or death, including costs of suit and attorney's fees, arising out of, or related to, any techniques/methods/advice learned in this course, regardless of whether such damages, injury or death are caused by the student's negligence or by the negligence of FurKids First Aid or its agents, employees, volunteers, or students.
Choice of Law. This Agreement shall be governed by, constructed and interpreted, and the rights of the parties hereto determined in a court of proper jurisdiction with venue in Queensland, Australia in accordance with the laws of the State of Queensland. The parties submit to the non-exclusive jurisdiction of the courts of this State and the Federal Court of Australia.
Representations of Student. The Student represents and warrants 1) that he/she is willingly participating in this course, 2) that he/she is executing this Agreement of his/her own free will and that he/she is not under any duress or undue influence to execute this waiver, 3) that he/she has carefully read this Agreement, and 4) that he/she is fully and completely informed about and clearly understands the terms of this Agreement.
